Brand Protection
Roselle® is a registered brand used to identify our current product collection presented through RoseToy.net. This statement explains our approach to trademarks, brand identity, original content, product representation and responsible use of Roselle materials.
U.S. Trademark Registration
ROSELLE is registered on the Principal Register of the United States Patent and Trademark Office for covered goods in International Class 010, including relevant intimate-wellness products such as sex toys and vibrators.

Protecting the Roselle® Identity.
Roselle® identifies our branded product collection. The Roselle name and associated brand presentation help customers distinguish Roselle products and information from unrelated products, sellers and websites.
Protecting that identity is important because products in the same broader category can look similar while coming from different sources and using different designs, controls, specifications and brand identities.
A product's general rose-inspired appearance alone does not make that product a Roselle product. Identification begins with the Roselle® brand and the relevant Roselle model.

What Roselle Brand Protection Can Cover.
Different types of brand and creative material may be protected under different legal rights. Depending on the particular material and applicable law, Roselle brand assets may include the following.
Trademark use associated with the Roselle branded collection.
Original Roselle logos and distinctive visual branding used to identify the collection.
Product photography and other original visual content where applicable rights are owned or controlled.
Original product descriptions, editorial materials and educational content created for the brand.
Original packaging graphics, layouts and branded creative materials developed for Roselle.
Model-specific brand presentation and other protectable elements where applicable.
The existence and scope of trademark, copyright, design or other intellectual-property rights can differ by asset, registration and jurisdiction.
Trademark Use
Use of the Roselle® Name and Brand Marks.
Roselle brand identifiers should not be used in a manner that falsely suggests that an unrelated product, seller, website or service originates from, is affiliated with, is endorsed by or is operated as part of Roselle or RoseToy.net.
This includes uses that could reasonably create confusion about the source, sponsorship or affiliation of a product or service.
At the same time, accurate references to Roselle may be appropriate in contexts such as commentary, editorial discussion, comparison or identification when the reference is truthful and does not misleadingly imply affiliation or endorsement.
Nothing in this statement is intended to restrict lawful descriptive, informational, comparative or other uses permitted under applicable law.
Brand & Category
Roselle® Is a Brand. “Rose Toy” Describes a Broader Product Category.
Rose-shaped intimate products are offered by many manufacturers and retailers. Descriptive expressions such as “rose toy” may be used in the marketplace to refer more broadly to this style or category of product.
Roselle®

Rose Toy
A broader descriptive expression that may refer to rose-inspired products from different brands and sellers.
RoseToy.net does not use this statement to claim exclusive rights over the general concept or appearance of all rose-shaped intimate products, or over descriptive product-category terminology where no such exclusive right exists.
Customers who want to check whether a product corresponds to a current Roselle model can compare its brand name, model information and specifications with the information published on RoseToy.net.
How to Identify Roselle® →Creative Content
Photography, Graphics and Written Materials.
RoseToy.net includes photography, graphics, written materials, layouts and other creative content used to present and explain the Roselle collection.
Where Roselle or RoseToy.net owns or controls rights in original creative material, that material should not be reproduced, republished, distributed or commercially used without appropriate permission, except where the use is otherwise permitted by applicable law.
Individual materials can have different ownership or licensing histories. The appearance of material on a product page or website does not, by itself, mean that every underlying element is claimed as exclusively owned.
This distinction is important to maintaining accurate and responsible intellectual-property claims.
Product Design
Product Appearance and Design Rights.
Certain product designs, packaging elements, graphics or other design features may be protected by intellectual-property rights where applicable.
Whether protection applies depends on the particular design, ownership history, registration status and applicable jurisdiction.
Registration of the Roselle trademark does not, by itself, create exclusive rights over every rose-shaped product design.
Trademark rights, copyright rights and design or patent rights are distinct legal concepts and should be evaluated separately.
Accurate Representation
Avoiding Confusion About Affiliation.
We ask third parties not to present themselves as Roselle, RoseToy.net, an authorized Roselle seller or an official Roselle channel unless that relationship actually exists.
Roselle branding, logos and original branded materials should not be presented in a way that could reasonably lead customers to believe an unrelated product or service originates from Roselle.
Accurate factual references, reviews, comparisons and commentary are different from falsely representing the source of a product or creating a misleading impression of authorization, affiliation or endorsement.
